Vehicle Forfeiture

Repeat offenders who continue to drive while their driver's license is suspended/revoked/denied, or who commit multiple substance abuse-related offenses, may be subject to vehicle forfeiture. The vehicle may be ordered sold by the Court if the defendant owns the vehicle in whole or in part. Return of the vehicle to the lessor will be ordered if the defendant leases the vehicle. Monies from the sale of the vehicle will be distributed according to the priorities defined by the statute (MCL 257.625n), first to pay secured interests and then to others. Please see the Repeat Offender Criminal Sentencing Chart below regarding permissibility of vehicle forfeiture.
